Effective September 30, 2024, SSA removed food from the ISM calculation for SSI and now considers shelter expenses only: room, rent, mortgage payments, real property taxes, heating fuel, gas, electricity, water, sewerage, and garbage collection services. SSA states the consequence in its own words: "Effective 09/30/2024, food is no longer included in ISM calculations. Before September 30, 2024, residents of seven excepted states (Connecticut, New York, Vermont, Illinois, Indiana, Wisconsin, and Texas) met the business-arrangement test when monthly required rent equaled or exceeded the PMV. In every state other than those seven, an SSI recipient's required monthly rent had to reach the current market rental value before September 30, 2024 to count as a business arrangement, a materially harder figure to reach when a parent rents a room from a child at a family rate. The amended 20 CFR 416.1130(b)(1) now provides that a business arrangement exists when the amount of monthly required rent to be paid equals or exceeds the presumed maximum value, and it says so for the whole country. Under 20 CFR 416.1130(b)(1), monthly required rent at or above the presumed maximum value is a business arrangement in every state as of September 30, 2024, but SSA's Program Operations Manual System (POMS) section SI 00835.380 tells SSA staff not to develop a rental subsidy at all unless someone in the household is a parent or child of the landlord or the landlord's spouse.U.S. Government Publishing Office. The amended regulation at 20 CFR 416.1130(b)(1) sets a general threshold, written in terms of the amount of monthly required rent measured against the PMV, and SSA described one of its goals in implementing the rule as bringing nationwide uniformity to the application of its rental subsidy policy. Answering commenters who asked SSA to make sure the policy reached everyone paying at least the PMV, SSA wrote: "When we apply our rental subsidy policy, all SSI applicants and recipients who pay a monthly required rent, under a rental agreement, equaling or exceeding the PMV will receive the benefit of this rule (or at least will not be disadvantaged by it)."U.S. Government Publishing Office. Neither layer cancels the other. For a reader the practical consequence runs one way: if a parent or child relationship to the landlord exists in the household, say so at the interview, because that answer is what opens SSA's rental-subsidy development on an SSI claim.
Who counts as a parent or a child here
POMS supplies its own definitions of parent and child for SSA's SSI rental-subsidy development step, and they are not symmetrical:
- Parent: a natural or adoptive parent, or the spouse of such a parent. Read those two together and one eldercare household falls outside the gate. A widowed step-parent who rents from her late spouse's child was the spouse of a parent while her husband lived. SSA's third 2024 rule widened the definition of a public assistance household at 20 CFR 416.1142(a) in two ways at once. SNAP was added to the list of qualifying public income maintenance payments. Since September 30, 2024, it takes two people rather than a whole household: an SSI applicant or recipient, plus at least one other member who receives one or more of the listed public income maintenance payments, with SNAP now on that list. The old definition required every member of the household to receive such a payment, so a single member without one kept the whole home outside it. Where the household qualifies, SSA does not develop inside ISM at all, which means the help a recipient gets from the people she lives with is never measured against her payment. I rent a room from my stepson. Does the rent rule apply to me?
SSA's amended rental-subsidy regulation sets the same threshold for you as for anyone else: since September 30, 2024, monthly required rent at or above the presumed maximum value (PMV) is a business arrangement in every state, so no room or rent in-kind support and maintenance is charged against the SSI payment. What differs is whether SSA examines your rent at all. SSA's own staff manual (POMS) asks first whether anyone in the household is a parent or child of the landlord or the landlord's spouse, and it counts a step-parent as a parent only while the natural or adoptive parent is living. So if your spouse, your stepson's natural or adoptive parent, has died, you sit outside SSA's rental-subsidy development gate.
