Yes, a sponsor's income counts against federal Supplemental Security Income (SSI) for a parent sponsored on a Form I-864 Affidavit of Support. When you sign a Form I-864 for a parent, the Social Security Administration (SSA) counts your income and resources toward hers when it decides her SSI eligibility and payment, a rule SSA calls sponsor deeming.U.S. Social Security Administration. Why a Sponsor's Income Counts Against Your Parent's SSI
You brought your mother or father here, you signed the paperwork, and now a notice says her SSI was denied or cut to a small amount because of your income. That can feel like being penalized for doing the right thing. It helps to know exactly what the rule does, because the details decide what you can change.
SSA states that since October 1980 the law has required a sponsor's income and resources, and those of the sponsor's living-with spouse, to be considered when it decides a sponsored noncitizen's SSI eligibility and payment amount.U.S. Social Security Administration. (1996). POMS SI 00502.200 Sponsor-to-Alien Deeming (1996-1997 Legislation) (SSA). secure.ssa.gov. Retrieved Sep 21, 2026, from https://secure.ssa.gov/poms.nsf/lnx/0500502200 So moving her into her own apartment doesn't, by itself, stop SSI from counting your income.
Having a sponsor doesn't make her ineligible, though. SSA states that sponsorship is not a factor of SSI eligibility, and that a noncitizen who has a sponsor is not automatically eligible or ineligible for SSI.U.S. Social Security Administration. (n.d.). POMS SI 00502.240 Legally Enforceable/New Version Affidavit of Support (I-864) (SSA). secure.ssa.gov. Retrieved Sep 26, 2026, from https://secure.ssa.gov/poms.nsf/lnx/0500502240 Sponsor deeming works on the money side of SSI. It adds part of your income to hers, and the result is what decides whether she qualifies and how much she gets. She also still has to meet SSI's separate immigration-status test, which our guide to whether a green card holder can get SSI walks through.
How Much of a Sponsor's Income Counts Against SSI
SSA doesn't add your whole paycheck to her income. It subtracts allowances first, and the method is set out in POMS SI 01320.950, which SI 00502.240 applies to I-864 cases.U.S. Social Security Administration. (n.d.). Here is how SSA computes the sponsor income it deems to a parent for federal SSI:
- Add up the sponsor household's income. SSA totals your earned and unearned income, plus your spouse's if the two of you live together.
- Subtract the allocations. SSA subtracts an allocation for you equal to the monthly SSI federal benefit rate (FBR) for one person; half the FBR for a spouse living with you, or a full FBR if your spouse co-signed as a sponsor; and half the FBR for each of your dependents other than your parent and her spouse.
- Count the rest as her income. What's left is treated as her unearned income and added to her own income, and SSA then subtracts the $20 general income exclusion from that total to reach her countable income.U.S. Social Security Administration. (n.d.). POMS SI 01320.950 Deeming of Income From a Sponsor of a Non-Citizen (SSA). secure.ssa.gov. Retrieved Sep 26, 2026, from https://secure.ssa.gov/poms.nsf/lnx/0501320950
Two details surprise families. The SSI income exclusions, including the earned income exclusions, don't apply to a sponsor's own income, so your wages go in at full value before the allocations. And if you sponsored both parents, SSA deems all of your income to each of them rather than splitting it.U.S. Social Security Administration. (n.d.). One piece of this works in your favor. While your income is being deemed to her, SSA states that cash and in-kind support and maintenance you provide to her are not counted as her income.U.S. Social Security Administration. (n.d.). Which Sponsor Rules Apply: The 1997 Dividing Line
SSI has two sets of sponsor deeming rules, and one date decides which your family is under. SSA ties it to the date your parent applied for her immigrant visa or for adjustment to permanent residence, not the date she arrived.U.S. Social Security Administration. (1996). | Visa or adjustment application filed | On or after December 19, 1997 | Before December 19, 1997 |
| Who it usually covers | Most family-based immigrants, including a parent sponsored by an adult child | Older cases; applies even if she entered after 1997 |
| How long SSI deeming lasts | No time limit; ends only on specific events | 3 years (36 months) after lawful admission |
| Exceptions | Four, listed by SSA; no others | SSA's separate exclusion list for old-version cases |

If you've read that SSI sponsor deeming ends after three years, that's the I-134 rule. For a parent you sponsored on an I-864, waiting for a three-year mark means waiting for a date that never comes.
When Does SSI Sponsor Deeming End?
Under SSA's I-864 rules there is no time limit on SSI sponsor deeming, so it continues until one of these events happens:U.S. Social Security Administration. (1996). - She becomes a naturalized U.S. citizen. SSI deeming stops the month after the month she naturalizes.
- She can be credited with 40 qualifying quarters. SSI deeming stops in the month she reaches 40.
- The sponsor dies. SSI deeming stops the month after the sponsor's death. SSA's manual adds that if the sponsor's spouse dies, deeming does not stop.
- She loses permanent residence and leaves the U.S. Both have to happen.
Naturalization and the 40 quarters are the two you can plan around. The statute behind the I-864 rules, 8 U.S.C. 1631, runs sponsor deeming until citizenship through naturalization or 40 qualifying quarters of coverage.U.S. Social Security Administration. (1996). Who Isn't Subject to Sponsor Deeming
For I-864 cases, SSA's manual lists four exceptions to SSI sponsor deeming and states that no other exceptions apply:U.S. Social Security Administration. (n.d.). - People with no sponsor. SSA says most refugees and asylees, people whose deportation or removal was withheld, and self-petitioners aren't required to have sponsors.
- The battery exception. A person who meets it may be exempt from sponsor deeming for 12 months, and longer only under certain specified conditions.
- The indigence exception. A person for whom losing SSI, or a cut in SSI, would cause indigence may be exempt, generally for 12 months at a time.
- 40 qualifying quarters. Once a permanent resident can be credited with 40, sponsor deeming doesn't apply.
One route families sometimes expect isn't on the list. Under SSA's I-864 rules, a parent who becomes blind or disabled after arriving is not exempt from sponsor deeming.U.S. Social Security Administration. (n.d.). The Indigence Exception, and Why It Rarely Helps If She Lives With You
The indigence exception exists for a parent whose sponsor has stepped away and left her without support. Under POMS SI 00502.280, SSA suspends sponsor deeming for an I-864-sponsored parent when two things are both true: deeming results in denial, suspension or a reduced SSI payment, and she can't obtain both food and shelter.U.S. Social Security Administration. (n.d.). POMS SI 00502.280 Indigence Exception to Sponsor Deeming (SSA). secure.ssa.gov. Retrieved Sep 26, 2026, from https://secure.ssa.gov/poms.nsf/lnx/0500502280
The condition that matters most for most readers is this one: if she lives with her sponsor, SSA assumes the sponsor is providing food and shelter, and the indigence exception will not be granted.U.S. Social Security Administration. Retrieved Sep 26, 2026, from https://secure.ssa.gov/poms.nsf/lnx/0500502280 So if your mother lives in your home, this exception isn't a route for her.
If she lives apart from you, SSA finds she can't obtain food and shelter when all the income she actually receives, of every kind and from every source, is below the SSI federal benefit rate and her available resources are under the SSI resource limit. Free room and board rules it out even if her income is below the FBR.U.S. Social Security Administration. (n.d.). POMS SI 00502.280 Indigence Exception to Sponsor Deeming (SSA). secure.ssa.gov. - When SSA grants the indigence exception, sponsor deeming is suspended for 12 months, and SSA decides again at the end of each 12-month period. The exception can be granted more than once.
- Whatever you actually give her, in cash or in kind, counts as her income during those months.
- If SSI is paid or increased because of the indigence exception, the I-864 sponsor is liable to repay the SSI paid.
- SSA must report every indigence case to the Department of Homeland Security.
What You Promised When You Signed the I-864
Words like "reimburse" and "Department of Justice" are hard to read when all you did was sign a form so your mother could join you here. Knowing exactly what the promise covers, and when it ends, puts you in a better position to decide what to ask SSA for.
The I-864 is a contract, and federal law makes it enforceable. Under 8 U.S.C. 1183a, the sponsor agrees to provide support to keep the sponsored immigrant at an annual income of at least 125 percent of the federal poverty line while the affidavit is enforceable. That promise can be enforced against the sponsor by the immigrant, the federal government, a state, or any other entity that provides a means-tested public benefit.Office of the Law Revision Counsel, U.S. House of Representatives. For SSI specifically, SSA states that if the sponsored immigrant later receives SSI, the sponsor is required to reimburse the agency for those benefits, and that if the sponsor doesn't repay, SSA refers the case to the Department of Justice for civil recovery.Office of the Law Revision Counsel, U.S. House of Representatives. The obligation has an end, and it lines up with the deeming rules. Under 8 U.S.C. 1183a, the affidavit is enforceable for benefits provided before the sponsored immigrant naturalizes, or until she has worked or can be credited with 40 qualifying quarters, if that comes first.Office of the Law Revision Counsel, U.S. House of Representatives. Frequently Asked Questions
Does SSI sponsor deeming end after 3 years?
Only under the old Form I-134, used when the visa or adjustment application was filed before December 19, 1997, where SSA sets the SSI deeming period at 3 years (36 months) after the date of lawful admission. Under those older I-134 rules, SSA states deeming may apply whether or not the sponsor actually provides any support. For an I-864 filed on or after December 19, 1997, SSA states there is no time limit on SSI sponsor deeming.U.S. Social Security Administration. (1996). Do my savings count against my mother's SSI too?
Yes.
