How the Birthday Rule Works

A Medicare supplement (Medigap) policy fills the gaps in Original Medicare, but its premium can rise over time. Outside a protected window, an Oklahoma insurer can normally review your health history before issuing a new policy, which means a switch can be denied or priced higher because of your medical record. The birthday rule removes that barrier once a year.

Under Oklahoma's rule, created by amendments to the Oklahoma Insurance Department's Medicare supplement regulations (OAC 365:10-5-129; OID Bulletin No. 10-2023), you get an annual 60-day open enrollment period that begins on your birthday. During those 60 days you may move to a different Medicare supplement policy without going through medical underwriting. The protection means an insurer cannot deny you or charge you more because of your past or current health.

This is an additional annual opportunity. It does not reduce or replace the federal Medigap Open Enrollment Period or any other guaranteed-issue right you already have. It simply adds one more guaranteed chance to shop your coverage every year.
