Can You Get Paid to Care for Your Spouse in Nebraska?

The short answer for 2026: yes through a Medicaid waiver if your spouse's needs qualify, no under the state plan benefit, and yes again through the VA if your spouse is a veteran.

Nebraska Medicaid covers care at home along several routes, and the rule on paying a family member differs on each. Personal Assistance Services (PAS) is the state plan route: help with activities of daily living such as bathing or dressing, for a person of any age who receives Medicaid, lives in their own home rather than an institution, and has an assessed need for the service in order to live in the community. On PAS, DHHS says a family member may be a paid provider as long as that family member is not legally responsible for you, and that a spouse, or the parent or guardian of a minor child, cannot be a paid provider.

The waivers work differently, and this is the part that is easiest to miss. Nebraska's home and community-based waivers carry a service called LRI Personal Care, and on the Aged and Disabled waiver it is the one service a Legally Responsible Individual, which DHHS defines as a spouse or the natural or adoptive parent of a minor child, can be paid to provide. That is your route, with the conditions set out below.

On the VA side, the route skips Medicaid's level of care test: VA's caregiver stipend expressly lets a spouse be the paid caregiver for a veteran who meets VA's requirements, starting with a 70 percent or higher disability rating.

LRI Personal Care: How Nebraska Pays a Spouse

DHHS's July 2026 resource for HCBS waivers defines a Legally Responsible Individual as a spouse or the natural or adoptive parent of a minor child, then sets out, service by service, who may be paid. On the Aged and Disabled (AD) waiver a relative may be paid to provide Personal Care, Respite and Chore, while an LRI may not. LRI Personal Care is the one AD waiver service an LRI may be paid for, and a relative who is not an LRI may not be paid for that one. The Traumatic Brain Injury (TBI) waiver follows the same pattern.

LRI Personal Care is offered on the AD waiver, all three Developmental Disabilities waivers, and, as of July 1, 2026, the TBI waiver. Three conditions come with it. People delivering it are W-2 employees rather than contractors. The service cannot be authorized until the provider is fully enrolled, so enrollment is not paperwork you can finish later. And it is tracked using an Extraordinary Care Tool and Electronic Visit Verification.

DHHS's LRI Personal Care guidance adds the conditions that decide whether a spouse is actually paid. The service can only be authorized if your spouse meets Nebraska's definition of Extraordinary Care on the Extraordinary Care Instrument (DD-26). Extraordinary Care means hands-on help with activities of daily living and instrumental activities of daily living beyond what a spouse would ordinarily do for a person of the same age without a disability or chronic illness. It is met when your spouse scores a "yes" in at least three areas of need, and only the needs scored "yes" may be authorized. The Service Coordinator completes the tool with your family, and it is completed again every year.

The limits are just as specific. LRI Personal Care cannot exceed 40 hours a week, and if your spouse is assessed at more than 40, only 40 hours are authorized across all LRI providers. The LRI must be employed by an agency to provide the service, except in limited circumstances, and the service may not be self-directed. It cannot be billed while you are engaged in other employment, and no other person may provide formal or informal help with daily activities during the same period you are billing for it. DHHS says LRI Personal Care is used when there are no other services or providers available to meet the participant's needs. DHHS marks three tasks as for a spouse LRI only: medication administration, accessing transportation, and communication.

One caution on the rulebook. Nebraska's provider regulation, 480 NAC 4 (effective October 3, 2021), still states that no one may provide services for a spouse. The LRI Personal Care route rests on DHHS's 2025-2026 waiver guidance and on the waiver renewal CMS approved effective July 1, 2026, not on that 2021 regulation.

Your spouse has to qualify for the waiver first

LRI Personal Care is a waiver service, so the waiver is the real gate. To be eligible for AD waiver services a person must already receive Nebraska Medicaid, have a disability or be over the age of 65, meet nursing facility level of care, and have a need for waiver services. Medicaid financial eligibility is a separate determination that comes first.

The AD waiver serves individuals ages 65 or older and individuals with physical disabilities ages 0 to 64. The TBI waiver serves individuals with brain injury ages 18 or older, at that same level of care. The three Developmental Disabilities waivers use an ICF/IID level of care instead, for people with autism, intellectual disabilities or developmental disabilities.

DHHS says an AD waiver participant may have a choice of service coordination provider depending on age: DHHS Local Offices serve all ages, and a participant 65 or older can use the local Area Agency on Aging, unless they already have a DHHS service coordinator and want to keep them. Whichever coordinator your spouse has completes the Extraordinary Care Tool with your family, so they are who you ask about LRI Personal Care. Why the State Plan Benefit Cannot Pay a Spouse

If someone tells you flatly that Nebraska will not pay a spouse, they may be talking about Personal Assistance Services, and about that benefit they are right.

When Medicaid pays a family member for personal care, it separates relatives who happen to help from relatives the law already expects to help. Nebraska puts a spouse in that second group, because DHHS defines a Legally Responsible Individual as a spouse or the natural or adoptive parent of a minor child.,

That status collides with how the basic home-care benefit is written. Under the Medicaid state plan personal care services benefit, the services must be provided by a qualified individual "who is not a member of the individual's family," and for that benefit a family member "means a legally responsible relative." Where a spouse counts as one, as they do in Nebraska, those two clauses shut them out of the state plan benefit. What they do not do is reach the waivers: that regulation is prefaced "Unless defined differently by a State agency for purposes of a waiver," so the state plan exclusion does not carry over automatically to a section 1915(c) waiver service.

PAS is a dead end for your paycheck but not for your household. Asked whether a participant can choose their own provider, DHHS answers "Yes, you have the right to choose your provider and direct your own care," so an adult child, a sibling, or a friend you pick can be the paid PAS provider, as long as they are not legally responsible for you and can meet the provider qualifications.

The VA Route: How to Get Paid to Care for Your Veteran Spouse in Nebraska

If the person you care for is a veteran, the picture changes, because the VA's caregiver stipend program expressly lets a spouse be the paid caregiver. These are VA programs, not Nebraska Medicaid ones.

The centerpiece is PCAFC, the Program of Comprehensive Assistance for Family Caregivers. It pays an eligible veteran's approved Primary Family Caregiver a monthly stipend, which VA treats as a nontaxable benefit, and a spouse is expressly allowed to serve as that caregiver. VA's first screen has four requirements, all of which must be true: a disability rating of 70 percent or higher, a discharge or medical discharge date, at least six months of continuous in-person personal care need, and enrollment in VA health care. Passing it is necessary but not sufficient, since the joint application adds conditions such as care at home and no other regular provider of the same care. Payment also waits on direct deposit enrollment through the VA customer engagement portal.

The stipend is not a single national figure. It starts from the federal GS-4, step 1 annual salary for the locality where the veteran lives, divided by 12, so the dollar base depends on where in Nebraska you live and is not an hourly wage. 38 CFR 71.40(c)(4)(i) then multiplies that monthly base by a factor: in the current program 0.625, or 1.00 if VA determines the veteran is "unable to self-sustain in the community." A veteran VA classes as a legacy participant or legacy applicant follows a separate schedule, which runs for eight years from October 1, 2020 and so lapses October 1, 2028; Caregiver Programs in Nebraska sets out both schedules in full. The second VA route is Veteran-Directed Care, a VA home and community based services program. The veteran receives a flexible budget, managed by the veteran or a representative, to hire and supervise their own workers, and the federal Administration for Community Living's description of the program says enrolled veterans may hire family, friends, or neighbors. Neither VA's page nor ACL's says whether a spouse can be one of those workers, so this is a question to put to the VA rather than an answer to count on. VA says an enrolled veteran is eligible if they are eligible for community care, meet the clinical criteria for the service, and it is available, and VA medical centers deliver it through local aging and disability network agencies such as Area Agencies on Aging. So ask the social work or geriatrics team at the VA Nebraska-Western Iowa Health Care System whether Veteran-Directed Care is available to your spouse.

Aid and Attendance

Aid and Attendance works differently from caregiver pay. It is not a wage paid to you as the spouse. It adds monthly payments to a VA pension: a pensioner may be eligible by meeting one of VA's listed needs, such as help with bathing, feeding, and dressing. The Veterans Pension requires wartime service, among other conditions.

It adds household income a couple can put toward care. For 2026 (effective December 1, 2025 through November 30, 2026), the Maximum Annual Pension Rate (MAPR) ceiling is $29,093 a year for a veteran with no dependents, $34,488 for a veteran with one dependent, and $18,697 for a surviving spouse with no dependents, each reduced by countable income. Aid and Attendance requires the veteran or survivor to already qualify for a VA pension, which has income and net-worth tests (the 2026 net worth limit is $163,699).

A tax note if a program does pay you: wages paid through a Medicaid home and community-based services waiver to a caregiver living in the same home may be excludable from federal gross income as "qualified Medicaid waiver payments" under IRS Notice 2014-7. It does not cover payments from the care recipient's private funds, and for other Medicaid pay the IRS says it depends on the nature of the payments and the program's purpose and design., The exclusion applies only to payments for care in your own home where your spouse lives under their plan of care, and it does not apply if you have a separate home where you reside. Separately, VA treats the PCAFC stipend as a nontaxable benefit.
