Nebraska Medicaid covers care at home along several distinct routes, and the rule on paying a family member is different on each one. Personal Assistance Services (PAS) is the state plan route: help with activities of daily living such as bathing or dressing, for a person of any age who receives Medicaid, lives in their own home rather than an institution, and has an assessed need for the service in order to live in the community. The waivers work differently, and this is the part most Nebraska spouses are never told. LRI Personal Care: How Nebraska Pays a Spouse

If you take one thing from this guide, take the name. Asking for "LRI Personal Care" is what gets you past the general "spouses cannot be paid" answer, because that general answer is about a different benefit.

DHHS's July 2026 resource for HCBS waivers defines a Legally Responsible Individual as a spouse or the natural or adoptive parent of a minor child, then sets out, service by service, who may be paid. On the Aged and Disabled (AD) waiver a relative may be paid to provide Personal Care, Respite and Chore, while an LRI may not. LRI Personal Care is the one AD waiver service an LRI may be paid for, and a relative who is not an LRI may not be paid for that one. The Traumatic Brain Injury (TBI) waiver follows the same pattern.

Read that twice, because the two lists are mirror images. The services that pay your adult daughter will not pay you, and the service that pays you will not pay her. Nebraska did not close the door on spouses. It put your door in a different wall.

Federal rules let each state decide how far it reaches. Under the section 1915(j) self-directed personal assistance option, a state may permit participants to hire "any individual capable of providing the assigned tasks, including legally liable relatives," and the regulation defines legally liable relatives to expressly include a spouse. States take that up in different ways: Arizona lets a legally responsible spouse be paid to provide attendant care to a member of its ALTCS long-term care program, and Minnesota's Community First Services and Supports allows a spouse to serve as a paid support worker., Nebraska's answer is LRI Personal Care, on its waivers.

Why the State Plan Benefit Cannot Pay a Spouse

If someone tells you flatly that Nebraska will not pay a spouse, they are almost certainly talking about Personal Assistance Services, and about that benefit they are right. Knowing the exact wording tells you which question to ask next.

When Medicaid pays a family member for personal care, it separates relatives who happen to help from relatives who are already legally expected to help. A husband or wife falls into the second group. In Medicaid's language a spouse is a "legally responsible relative," one of the people who have a duty under state law to care for another person.

That status collides with how the basic home-care benefit is written. Under the Medicaid state plan personal care services benefit, the services must be provided by a qualified individual "who is not a member of the individual's family," and for that benefit a family member "means a legally responsible relative." Read together, those two clauses mean a spouse cannot be the paid worker under the standard state plan personal care benefit. Second, the PAS rule is not the last word on your situation. It is the state plan answer, and LRI Personal Care sits on the other side of that line.

The VA Route: How to Get Paid to Care for Your Veteran Spouse in Nebraska

If the person you care for is a veteran, the picture changes entirely, because the VA is designed to pay spouses. These federal programs work the same in Nebraska as anywhere else.

The centerpiece is PCAFC, the Program of Comprehensive Assistance for Family Caregivers. It pays an eligible veteran's approved Primary Family Caregiver a tax-free monthly stipend, and a spouse is expressly allowed to serve as that caregiver. To qualify, the veteran generally needs a VA disability rating of 70 percent or higher, must need at least six months of continuous in-person personal care, and must be enrolled in VA health care.
