In-home care carries its own conditions, and they are worth getting right before you file. Payments for help with activities of daily living and instrumental activities of daily living by an in-home attendant are medical expenses as long as the attendant provides the person with health care or custodial care, and the payments must be commensurate with the number of hours the provider actually attends to them. The attendant must be a health care provider, unless the person needs aid and attendance or is housebound, or a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that, because of a physical, mental, developmental, or cognitive disorder, the person requires the health care or custodial care that the in-home attendant provides. So a family hiring an aide who is not a health care provider should expect to show either that the person needs aid and attendance or is housebound, or that written clinician statement.

Think of it in annual terms. If a veteran with no dependents pays for in-home care that meets those conditions, only the first $872 of that yearly cost is not deductible; everything above that floor reduces countable income. With in-home care running about $101,816 a year in Maine, that deduction can be large enough that someone whose income looked too high ends up qualifying. The VA has you report these costs on VA Form 21P-8416 (Medical Expense Report), for expenses you paid and weren't reimbursed for and don't expect to be reimbursed for.

Who Qualifies

To be eligible for Aid and Attendance, the veteran must:

  • Not have received a dishonorable discharge
  • Meet the wartime service test for when their service began. The VA lists three paths, and meeting one is enough. Active duty that started before September 8, 1980: at least 90 days of active duty with at least one day during a wartime period. Enlisted service that started after September 7, 1980: at least 24 months (with some exceptions), or the full period for which they were called or ordered to active duty, again with at least one day during wartime. Officer service that started after October 16, 1981: the veteran had not previously served on active duty for at least 24 months, again with at least one day during wartime.,
  • Meet at least one of four conditions: be 65 or older, have a permanent and total disability, be a patient in a nursing home for long-term care because of a disability, or be getting Social Security Disability Insurance or Supplemental Security Income. Any one of the four satisfies this test on its own, so a wartime veteran under 65 who receives SSI meets this test without a permanent and total disability rating.
  • Have a need for aid and attendance, meaning at least one of these is true: needing another person to help with daily activities like bathing, feeding, and dressing; having to stay in bed, or spend a large portion of the day in bed, because of illness; being a patient in a nursing home due to the loss of mental or physical abilities related to a disability; or eyesight limited, even with glasses or contact lenses, to 5/200 or less in both eyes, or a visual field contracted to 5 degrees or less. In judging the need for help, the VA's regulation (38 CFR 3.352(a)) weighs factors such as an inability to dress or undress or to keep oneself ordinarily clean and presentable; a frequent need to adjust a special prosthetic or orthopedic appliance that, because of the disability, cannot be done without help (not appliances anyone would need help with, such as supports, belts, or lacing at the back); an inability to feed oneself or to attend to the wants of nature; or a physical or mental incapacity requiring care or assistance on a regular basis to protect against the hazards of daily life. Not every factor has to be present, and the need has to be regular, not constant.
  • Have yearly family income and net worth within the limits Congress sets; the net worth limit is $163,699 for 2026. The calculation includes the claimant's and dependents' assets and income for VA purposes, and assets exclude the primary residence, the car, and basic home items like appliances.

The VA also reviews assets transferred for less than fair market value in the 3 years before the claim, and a transfer inside that window that would otherwise have pushed net worth over the limit can trigger a penalty period of up to 5 years. For a surviving spouse, the VA's Survivors Pension carries its own 2026 Aid and Attendance rate, $18,697 a year for a surviving spouse with no dependents, with the same $163,699 net worth limit.

When a Family Member Provides the Care

If a son, daughter, or other relative is the one giving the care, that does not, on its own, stop the VA from granting the Aid and Attendance allowance: the regulation says care from a relative or another member of the household will not prevent it.

There is also a separate VA program built for this. Veteran-Directed Care gives an enrolled veteran a flexible budget, managed by the veteran or a representative, to hire their own caregivers, including family, friends, or neighbors. VA medical centers run it through local aging and disability network agencies, such as Area Agencies on Aging, whose options counselor helps plan the services and arranges fiscal management services. For care at home through MaineCare's Home and Community Based Waivers, the manual says Aid and Attendance pension amounts are not used to determine the cost of care. Facility care is different. A federal rule for people in medical institutions and intermediate care facilities, 42 CFR 435.725, says income disregarded at eligibility must be considered in the cost-of-care calculation. The manual names two exceptions to its exclusion: VA benefits above $90 a month count toward the cost of care for a State Veteran's Nursing Home resident who is a veteran or surviving spouse with no dependents, and no exclusion applies in a residential care facility, cost reimbursement boarding home or adult family care home. It does not say how an ordinary nursing facility treats the Aid and Attendance amount, so confirm that with the Maine DHHS Office for Family Independence before budgeting a move. Whatever income does count toward a nursing-facility resident's cost of care is first reduced by five deductions 42 CFR 435.725(c) requires, in the order the regulation sets them out: (1) a personal needs allowance the resident keeps for clothing and other personal needs; (2) for a resident with only a spouse at home, an amount for that spouse's maintenance needs; (3) for a resident with a family at home, an amount for the family's maintenance needs; (4) incurred expenses for medical or remedial care that no third party will pay; and (5) any SSI and state supplementary payments the resident keeps receiving. All five are deductions the state has to make, not benefits a family applies for. They may not be the only ones: the federal rule also lets a state choose to deduct an amount to keep up the home for up to 6 months when a physician certifies the resident is likely to return home in that time, so ask the Office for Family Independence whether Maine offers it. A separate federal rule matters if in-home care later gives way to a nursing home: under 38 U.S.C. 5503(d), a veteran with no spouse or child (or a surviving spouse with no child) whose nursing-facility care is covered by Medicaid receives no more than $90 a month in pension after the month of admission, and that reduced amount is treated as an aid and attendance allowance, not income. Medicaid's payment to the nursing facility cannot be reduced by that $90. A veteran with a spouse or child is outside that cap, and a State Veterans Home for which the VA pays a nursing-care per diem is excluded from it, so check a specific stay with a Veteran Service Officer.
