Here's what the 2026 maximums look like, effective December 1, 2025 through November 30, 2026. VA publishes these as annual rates but pays pension monthly: under 38 CFR 3.273, it subtracts your countable income from the annual rate and divides the remainder by 12.1

These are ceilings, not awards. The figure above is the maximum amount of pension payable, and the VA pays the difference between the claimant's income for VA purposes and that limit, so most families receive less than the maximum.1 Each additional dependent adds $2,984 a year, and two veterans married to each other use a separate VA table, where the ceiling reaches $46,143 a year if both qualify for Aid and Attendance.1

Set the rates against the cost of care. To meet the aid-and-attendance need, a veteran has to require help with daily activities, such as bathing, dressing, or feeding themselves, or need protection from the hazards of the daily environment.6 Someone living with Alzheimer's or another dementia often meets one or both: VA's rule weighs physical or mental incapacity that requires care or assistance on a regular basis to protect a person from the hazards of the daily environment, and the evidence only has to show a regular need for aid and attendance, not a constant one.6 Being a patient in a nursing home because of the loss of mental or physical abilities related to a disability is itself one of the qualifying conditions the VA lists, but living in an assisted living memory care community is not on that list, so a memory care resident qualifies through the need for help or protection instead.6

The need is documented on a medical exam form (covered below), so the key is having the medical examiner describe, in plain clinical terms, the help your loved one requires day to day.

How Memory Care Costs Lower Your Countable Income

This is the part that's easiest to miss, and it's where memory care and Aid and Attendance fit together.

The VA pension is needs-based: to be eligible, your yearly family income and net worth have to meet limits set by Congress.1 Because the benefit is keyed to the income the VA counts, lowering that income matters, and you lower it by deducting unreimbursed medical expenses.1

A memory care community falls under VA's rule for a care facility other than a nursing home, which must be licensed where the state requires it and, if residential, staffed with care providers 24 hours a day.1 Payments for health care from a health care provider there are medical expenses, and payments for help with daily activities count too, even when the person giving that help isn't a health care provider, if the person is receiving health care or custodial care in the facility and either qualifies for aid and attendance or is housebound, or a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that, because of a physical, mental, developmental, or cognitive disorder, the person needs to be in a protected environment.1 Meals and lodging count too if the facility provides or contracts for that care, or if one of those clinicians states in writing that the person must live in the facility to receive it.1

There's one rule to know: only the portion of those expenses above 5% of the applicable annual MAPR is deductible, counting the increase for family members but not the increase for aid and attendance or housebound status.1 For 2026, that 5% floor is $872 per year for a veteran with no spouse or child, and it rises with dependents.1 A year of memory care in Minnesota runs far above that floor, so a veteran whose income looks too high can still qualify if the deductible care costs bring countable income below the pension limit.1,5

Who Qualifies

To be eligible for Aid and Attendance, the veteran must:6

• Have wartime service: if active duty started before September 8, 1980, at least 90 days with at least one day during a wartime period such as WWII, Korea, Vietnam, or the Gulf War (which has no end date yet, so it includes post-9/11 service). Someone who started active duty as an enlisted person after September 7, 1980 generally needs 24 months or the full period they were called or ordered to serve, with at least one day during wartime, and officers who started after October 16, 1981 have their own rule.
• Have a discharge that is not dishonorable.
• Meet at least one of four alternatives: be 65 or older, have a permanent and total disability, be a patient in a nursing home for long-term care because of a disability, or be getting Social Security Disability Insurance or Supplemental Security Income. Any one of the four satisfies this test, so a wartime veteran under 65 who receives SSI meets it without a permanent and total disability rating.
• Need help with daily activities: such as bathing, dressing, or feeding yourself, needing protection from the hazards of the daily environment, having to stay in bed for a large part of the day because of illness, being a patient in a nursing home because of the loss of mental or physical abilities related to a disability, or having severely limited eyesight.
• Have yearly family income and net worth within the limits Congress sets: the net worth limit is $163,699 for 2026, counting assets and annual income but excluding your primary home, your car, and basic household items.6

None of those requirements calls for a service-connected disability: Veterans Pension is what MDVA calls non-service connected pension.6,9 The VA also applies a 3-year look-back on assets transferred for less than fair market value in the 36 months before it receives your claim, and a covered transfer can draw a penalty period of up to five years, so don't give away or move assets to qualify without getting advice first.6

How Aid and Attendance Works with Minnesota Medicaid

Aid and Attendance and Medicaid are separate programs run by different agencies under different rules, and for a Minnesota senior who also needs Medicaid to help pay for long-term care, the two interact.8 Minnesota Medical Assistance (MA) is administered by the Minnesota Department of Human Services.8

The two programs count income differently, and that matters. For the VA pension, unreimbursed medical expenses can be used to reduce countable income.8 Under Minnesota Medical Assistance eligibility policy for the aged, blind, and disabled, the VA Aid and Attendance benefit is counted as income and is not excluded, even for a person receiving SSI.8 That's a state-specific treatment, since not every state counts Aid and Attendance the same way.8

Where your loved one lives also matters. If a veteran with no spouse or child, or a surviving spouse with no child, moves into a nursing facility and Medicaid covers that care, federal law caps the VA pension at $90 a month for any period after the month of admission, not the full Aid and Attendance rate.8 That cap does not reach a State home for which VA makes per diem payments for nursing home care, so check a Minnesota Veterans Home stay against the rule with an accredited Veteran Service Officer.8 We haven't found a Minnesota source that says how MA treats Aid and Attendance for someone getting waiver services outside a nursing facility, so confirm how your own VA pension and Aid and Attendance payments will be treated with your County Veterans Service Officer and your county MA eligibility worker before you commit to a plan.8

How to Apply and Get Free Help

These are the VA forms a memory care claim usually involves:10

• VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance), whose examination information section a medical examiner must fill out to document the need for help. For a dementia claim, this is where the examiner describes the cognitive impairment and the daily help it requires.
• VA Form 21P-527EZ (Application for Veterans Pension), if the veteran isn't already receiving a VA pension.
• VA Form 21P-8416 (Medical Expense Report), for reporting the unreimbursed medical expenses, such as qualifying memory care costs, that can lower countable income.

You can file online at va.gov, by mail to the VA Pension Intake Center, or in person at a VA regional office, and an accredited attorney, claims agent, or Veterans Service Organization representative can help you file.10 VA's Aid and Attendance page gives no timeframe for a decision, answering only "It depends"; VA processes claims in the order it receives them, unless a claim requires priority processing.10 If you're still gathering records, you can submit VA Form 21-0966 (Intent to File) first, which VA says can secure the earliest possible effective date for any retroactive payments.10

Don't do this alone. The Minnesota Department of Veterans Affairs (MDVA) is the state veterans agency, and Minnesota law requires a county board, alone or jointly with other county boards, to appoint a County Veterans Service Officer (CVSO) whose duty is to help residents secure the benefits provided by law for military service that ended in a discharge other than dishonorable.
