SMC Aid and Attendance vs. Pension Aid and Attendance at a Glance
The confusion is understandable. The U.S. Department of Veterans Affairs uses the words "aid and attendance" in two programs that work on different logic.
VA disability compensation pays veterans for conditions caused or worsened by military service. VA describes special monthly compensation (SMC) as "a higher rate of compensation that we pay to Veterans as well as their spouses, surviving spouses, and parents with certain needs or disabilities."Office of the Law Revision Counsel, U.S. House of Representatives. (n.d.). 38 U.S.C. 1114 — Rates of wartime disability compensation (Office of the Law Revision Counsel, uscode.house.gov). uscode.house.gov. Retrieved Sep 27, 2026, from https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title38-section1114&num=0&edition=prelim VA says it bases the monthly VA compensation payment on the veteran's disability rating and details about dependent family members.U.S. Department of Veterans Affairs. The Veterans Pension is VA's needs-based benefit for wartime veterans. VA Aid and Attendance on the pension side provides monthly payments added to a VA pension, and VA Pension eligibility requires yearly family income and net worth within limits Congress sets; from December 1, 2025 to November 30, 2026 the VA Pension net worth limit is $163,699.U.S. Department of Veterans Affairs. Who Qualifies for SMC-L Aid and Attendance?
Under federal law, 38 U.S.C. 1114(l), SMC-L is payable when the veteran, as the result of service-connected disability, meets one of these conditions:Office of the Law Revision Counsel, U.S. House of Representatives. (n.d.). 38 U.S.C. 1114 — Rates of wartime disability compensation (Office of the Law Revision Counsel, uscode.house.gov). uscode.house.gov. - anatomical loss or loss of use of both feet, or of one hand and one foot
- blindness in both eyes with 5/200 visual acuity or less
- being permanently bedridden
- being so helpless, or having such significant disabilities, as to need regular aid and attendance
The words "as the result of service-connected disability" carry the whole rule. For SMC-L, the need for help has to come from a service-connected condition, not from an unrelated illness.Office of the Law Revision Counsel, U.S. House of Representatives. (n.d.). 38 U.S.C. 1114 — Rates of wartime disability compensation (Office of the Law Revision Counsel, uscode.house.gov). uscode.house.gov. For SMC-L, VA's SMC regulation, 38 CFR 3.350(b)(3), says the criteria for deciding that a veteran needs regular aid and attendance are those in 38 CFR 3.352(a).Office of the Law Revision Counsel, U.S. House of Representatives. (n.d.). Eligibility For Veterans Pension. va.gov. Retrieved Jul 31, 2026, from https://www.va.gov/pension/eligibility/
The text of 38 CFR 3.352 adds two details families should know: not every listed condition has to be present, and the evidence needs to show a need for regular aid and attendance, not constant help.U.S. Department of Veterans Affairs. (n.d.). Eligibility For Veterans Pension. va.gov. Retrieved Jul 31, 2026, from https://www.va.gov/pension/eligibility/
Permanently bedridden is its own SMC-L route, and under 38 CFR 3.350(b)(4) its criteria are also in 38 CFR 3.352(a).Office of the Law Revision Counsel, U.S. House of Representatives. SMC-S: The Housebound Level of Special Monthly Compensation
SMC-S is the compensation-side counterpart of the housebound rate. Under 38 U.S.C. 1114(s) and 38 CFR 3.350(i), SMC-S is payable when the veteran has a single service-connected disability rated 100 percent and also meets one of two conditions:Office of the Law Revision Counsel, U.S. House of Representatives. (n.d.). 38 U.S.C. 1114 — Rates of wartime disability compensation (Office of the Law Revision Counsel, uscode.house.gov). uscode.house.gov. - has additional service-connected disability or disabilities independently ratable at 60 percent or more, separate from the 100 percent disability and involving different parts or systems of the body, or
- is permanently housebound by reason of service-connected disability, meaning substantially confined to the home and immediate premises (or to the ward or clinical area, if institutionalized), and it is reasonably certain the confinement will continue for life.
Both SMC-L and SMC-S turn on service-connected disability.Office of the Law Revision Counsel, U.S. House of Representatives. When It Is the Spouse Who Needs Aid and Attendance
Sometimes the veteran is stable and the spouse is the one who now needs daily help. VA disability compensation has a separate provision for that. Under 38 U.S.C. 1115, a veteran whose disability is rated at least 30 percent is entitled to additional compensation for dependents, including an added amount for a spouse who is a patient in a nursing home, or who is blind or so nearly blind or significantly disabled as to need regular aid and attendance.U.S. Department of Veterans Affairs. Can You Get SMC and Pension Aid and Attendance at the Same Time?
