For a veteran with little or no countable income, a pension awarded at the full ceiling of up to $29,093 a year can cover more than a third of the $76,080 median yearly assisted living cost, making a meaningful contribution toward keeping a veteran in the care setting that fits their needs. A household with countable income is awarded less, because the VA pays only the difference.,

How Aid and Attendance Helps Pay for It

On the pension route, which is the one most assisted living families use, Aid and Attendance is not a separate check alongside the VA pension. It raises the ceiling on the pension itself (what the VA calls the Maximum Annual Pension Rate) for veterans who need another person's help with daily activities, have to stay in bed because of illness, are a patient in a nursing home due to the loss of mental or physical abilities related to a disability, or have severely limited eyesight. The VA pays the difference between countable income and that ceiling, so the figures below are maximums rather than flat payments, and each household's actual award is that ceiling less its countable income. There is a second route: the VA describes Form 21-2680 as the way to apply for Aid and Attendance benefits "that will be added to your monthly compensation or pension benefits," so a veteran who receives VA disability compensation rather than a pension can seek the increase on that compensation instead.

The VA publishes these rates as annual maximums, but pension is paid monthly: under 38 CFR 3.273, VA reduces the applicable maximum rate by your countable income and divides the remainder by 12, and 38 CFR 3.29(b) rounds the result down to the whole dollar. When two veterans are married to each other and both qualify for Aid and Attendance, their joint ceiling is $46,143 a year, and each additional dependent adds $2,984 a year.

On the pension route, Aid and Attendance comes as part of a monthly pension payment to the veteran or surviving spouse rather than as a payment to the facility, so the family decides how to put it toward assisted living room and board, personal care, or memory care.

Because the VA pays the difference between income for VA purposes and the ceiling, other income the VA counts lowers the award rather than adding to it, and the pension is one part of paying for assisted living rather than the whole bill.

How Assisted-Living Costs Lower Your Countable Income

Aid and Attendance is a needs-based benefit: the VA pays the difference between a veteran's countable income and the applicable maximum annual pension rate (MAPR). The less countable income a veteran has, the higher the monthly benefit.

Here is the key: unreimbursed medical expenses (UMEs) reduce countable income. Only the portion of UMEs that exceeds 5 percent of the applicable MAPR is deductible, and for 2026 that floor is $872 per year for a veteran with no spouse or child. The floor rises for a veteran with dependents, but it never reflects the aid-and-attendance or housebound increase.

Assisted living fees can count toward those unreimbursed medical expenses when the resident is receiving health care or custodial care in the facility and either the veteran meets the aid-and-attendance or housebound criteria or a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that the veteran needs to be in a protected environment. The meals-and-lodging portion carries its own condition: the facility has to provide or contract for that care, or a clinician has to state in writing that the veteran must live there to receive it.

In practice: A veteran with no spouse or child in a West Virginia assisted living facility paying $76,080 a year in assisted living costs who has $24,000 in annual income for VA purposes, and who meets the conditions above, can deduct $76,080 minus $872 (the annual floor) = $75,208 from countable income, significantly reducing it below the pension threshold and qualifying for a substantial monthly benefit.,

This UME offset means a veteran who appears over-income can still qualify once qualifying care costs are deducted.

Who Qualifies

To receive Aid and Attendance, a veteran must not have received a dishonorable discharge, and must meet all four requirements below:

  • Wartime service: What counts turns on when the veteran started active duty, not on which war they served in. The VA asks that at least one of the paths on its list be true. A veteran who started active duty before September 8, 1980 needs at least 90 days of active duty with at least one day during a qualifying wartime period (such as World War II, Korea, Vietnam, or the Gulf War, which began August 2, 1990 and has no end date set yet). A veteran who started active duty as an enlisted person after September 7, 1980 needs at least 24 months, or the full period they were called or ordered to active duty (with some exceptions), again with at least one day during wartime. And a veteran who was an officer and started active duty after October 16, 1981 qualifies on the VA's third path if they had not previously served on active duty for at least 24 months, again with at least one day during wartime.,
  • Age, disability, nursing home, or SSDI/SSI: The VA lists four alternatives here, and meeting any one of them satisfies the test: at least 65 years old; a permanent and total disability; a patient in a nursing home for long-term care because of a disability; or getting Social Security Disability Insurance or Supplemental Security Income. The last two stand on their own, so a wartime veteran under 65 who receives SSI meets this test with no adjudicated disability rating.
  • Need for care: Needs another person's help with everyday activities such as dressing, bathing, feeding, or attending to the wants of nature; or needs care or assistance on a regular basis to stay safe from everyday hazards; or is bedridden; or is a patient in a nursing home because of a loss of mental or physical abilities related to a disability; or has eyesight of 5/200 or less in both eyes, or a visual field narrowed to 5 degrees or less.
  • Net worth under $163,699: The VA's net worth calculation includes the claimant's and their dependents' assets and their annual income for VA purposes, but excludes the primary home, the car, and basic home items like appliances. Comparing assets alone against the limit gives the wrong answer.,

The VA enforces a 3-year look-back period on asset transfers. Assets transferred for less than fair market value within three years of filing may trigger a penalty period.

A surviving spouse of a wartime veteran can also qualify for Aid and Attendance, at a Survivors Pension ceiling of up to $18,697 a year, subject to the same $163,699 net worth limit and a qualifying need for care.

How Aid and Attendance Works with West Virginia Medicaid

VA Aid and Attendance and West Virginia Medicaid are separate programs that can interact for veterans needing long-term care. West Virginia Medicaid, administered by the Department of Human Services, Bureau for Medical Services (BMS), has its own income and asset eligibility rules.

At the eligibility step, federal rules require West Virginia to apply the financial methodologies of the cash assistance program most closely related to the applicant's status, which for aged, blind, and disabled applicants is SSI, and West Virginia is not among the eight states SSA identifies as having elected the more restrictive 209(b) option. Under SSI methodology, "VA aid and attendance and housebound allowances are not income for SSI purposes", so only the basic pension counts toward the income limit. When a veteran with neither a spouse nor a child, or a surviving spouse with no child, is covered by Medicaid for nursing-facility care, the VA may pay no more than $90 a month in pension for any period after the month of admission, and the facility cannot count that $90 toward the cost of care. In West Virginia, that $90 becomes the resident's monthly personal needs allowance in place of the standard $50, not on top of it. If a nursing-home move is ever on the table, note which facility: 38 U.S.C. 5503(d)(1)(B) defines a nursing facility as one described in section 1919 of the Social Security Act, "other than a facility that is a State home with respect to which the Secretary makes per diem payments for nursing home care pursuant to section 1741(a) of this title", and 38 CFR 3.551(i) states the cap without repeating that definition, so a Medicaid-covered stay in a West Virginia state veterans facility should be checked against the statutory definition rather than assumed to fall under the cap. A resident the cap does not reach takes West Virginia's $50 standard allowance instead.

The SSI rule that leaves the Aid and Attendance allowance out of income applies at the eligibility step only. For someone already eligible and living in a nursing facility, federal post-eligibility rules say income disregarded at eligibility must be considered, so an Aid and Attendance amount still paid at the full rate can raise what the resident owes the facility unless a state rule exempts it, and those federal rules do not on their own settle how home and community-based waiver services treat it. How that lands on a specific household's numbers depends on its other income and expenses, so confirm your own figures with West Virginia BMS/Medicaid and a free accredited Veteran Service Officer before relying on any specific outcome.

How to Apply and Get Free Help

The steps below are the pension route, the one a veteran in assisted living usually takes. The VA states the condition plainly: you may be eligible for this benefit if you get a VA pension and meet at least one of its aid-and-attendance requirements. That route uses two forms:

  • VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance): the examination section is filled out by a medical examiner, documenting the need for care. This is also the form the VA points to for Aid and Attendance "that will be added to your monthly compensation ... benefits," so a veteran on the compensation side files it too.
  • VA Form 21P-527EZ (Application for Veterans Pension): the financial and service-history application, filed by a wartime veteran pursuing the pension route who is not already receiving a VA pension. It is the wartime, means-tested pension application, so it is not the form for a veteran whose Aid and Attendance would be added to VA disability compensation.

Asked how long a decision takes, the VA answers "It depends," adding that it processes claims in the order it receives them, unless a claim requires priority processing.

Get free, accredited help in West Virginia. The West Virginia Department of Veterans Assistance (WVDVA) operates benefits offices throughout the state, plus a claims office in Huntington. Accredited Veterans Service Officers at these locations advise veterans and their families on benefits questions, assist with filing claims, and can represent a veteran to the Veterans Benefits Administration when the veteran disagrees with a decision on a claim.
