How Aid and Attendance Helps Pay for a Nursing Home

Aid and Attendance is not a separate program. It is a higher pension rate the VA pays a veteran or surviving spouse who needs help with daily activities, is bedridden, or is a patient in a nursing home because of disability.

For 2026, the most a person can receive is the Maximum Annual Pension Rate. That rate is a ceiling on the entire pension, basic amount included, and the VA pays the difference between it and your countable income.

One thing to know before you read the numbers: the VA publishes these rates as annual maximums, but it pays the pension monthly. Under 38 CFR 3.273, the monthly payment is your annual rate minus your countable income, divided by 12. The one monthly figure the VA prints itself is $2,874, its penalty-period rate under 38 CFR 3.276(e)(1), which is exactly $34,488 divided by 12.

Two points families miss. First, these are maximums, not flat checks: the amount you receive depends on your other income and the medical expenses you can deduct. Second, the VA does not pay this money to the nursing home. It pays the veteran, who then applies it toward care. How Nursing Home Costs Lower Your Countable Income

Who Qualifies

To receive Aid and Attendance, a veteran generally must meet all of the following:

  • Wartime service: the length required turns on when the veteran started active duty, not on which war they served in. Started before September 8, 1980: at least 90 days of active duty with at least one day during a wartime period. Started as an enlisted person after September 7, 1980: at least 24 months, or the full period they were called or ordered to active duty (with some exceptions), again with at least one day during wartime. A third branch covers an officer who started on active duty after October 16, 1981 and had not previously served on active duty for at least 24 months. Recognized wartime periods include WWII, Korea, Vietnam, and the Gulf War, which runs from August 2, 1990 through a future date still to be set by law or presidential proclamation.
  • Discharge: the veteran's discharge must not be dishonorable.
  • Age, disability, or care status: the veteran must meet at least one of four conditions, any one of which satisfies this test: 65 or older; a permanent and total disability; a patient in a nursing home for long-term care because of a disability; or getting Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). A permanent-and-total rating is not the only route. A wartime veteran under 65 who receives SSI meets this test on that branch alone, with no adjudicated rating.
  • Need for aid: at least one of these: needing another person's help with daily activities such as bathing, dressing, or feeding; being bedridden; being a patient in a nursing home due to the loss of mental or physical abilities related to a disability; or limited eyesight (5/200 or less in both eyes, or concentric contraction of the visual field to 5 degrees or less, even with glasses or contacts).
  • Net worth under $163,699 for 2026. The VA's net-worth calculation counts the claimant's and their dependents' assets and annual income together, excluding the primary residence, a vehicle, and basic home items, so comparing assets alone against the limit gives the wrong answer.

The VA also enforces a 3-year look-back on assets transferred for less than fair market value, with a penalty period that can reach five years. A veteran living in a nursing home because of disability satisfies the "need for aid" test, so for nursing-home residents the eligibility question usually turns on wartime service, net worth, and income.

The $90/Month Nursing-Home Pension Cap

Here is the rule that surprises families most. Once Wisconsin Medicaid is paying for a veteran's nursing-home care, federal law sharply limits the VA pension.

Under 38 U.S.C. 5503(d)(2), implemented at 38 CFR 3.551(i), when a veteran with no spouse or child, or a surviving spouse with no child, is covered by Medicaid in a nursing facility, the pension, including any Aid and Attendance amount, is limited to no more than $90 a month. The statute and the regulation start that cap on different dates: the statute after the month of admission, the regulation after the month Medicaid payments begin. If the veteran entered as a private payer months before Medicaid started, check which date the VA applied to the award. Where the VA awards that $90 rate, it says the facility "can't count this monthly payment as income toward your cost of care" and that "You would keep the full $90 for personal expenses." Wisconsin's Medicaid Eligibility Handbook says the same in its own terms: a reduced pension of $90 or less is always treated as Aid and Attendance, and the full amount is disregarded for both eligibility and patient liability. Whether and how that $90 interacts with any personal-needs allowance under Wisconsin Medicaid is a state-rules question, so ask your caseworker rather than assuming the two amounts add together.
