Which Family Caregivers Wyoming's DD Waivers Can Pay
Wyoming Medicaid Rules Chapter 45, Sections 3 and 31, and the Comprehensive and Supports Waiver Service Index (effective July 22, 2026) set family pay on Wyoming's DD Waivers, and both define a "relative" as a participant's biological, step or adoptive parent only.Wyoming Department of Health. (2019). Wyoming Medicaid Rules Chapter 45: DD Waiver Provider Standards, Certification, and Sanctions (Wyoming Department of Health posting). health.wyo.gov. | Your relationship | What Wyoming's rules say |
|---|---|
| Parent | Personal care: as a certified provider with an LLC or corporation, or a certified provider's employee. Community living services: stricter rules. Never through self-direction |
| Spouse | Paid only with a certified court order naming someone else as legally authorized representative; not through self-direction |
| Legal representative of an adult (18+) | Can't be paid directly or indirectly except as the Service Index allows; not authorized to provide personal care |
| Parent of a child under 18 | Only personal care, specialized equipment and environmental modifications; personal care only for assessed extraordinary care needs |
| Legal representative of a child under 18 | May provide personal care to their ward under the same relative-provider restrictions |
| Adult child, sibling or other family member | Chapter 45 and the Service Index define "relative" as a parent only; see the FAQ below |
If you're also your adult child's guardian, this can be hard to hear after years of unpaid care: Wyoming's DD Waiver Relative Disclosure and Acknowledgment Form (PV11) says a legally authorized representative of a participant 18 or older can't serve as a relative provider. Wyoming Medicaid Rules Chapter 45 also counts it as the representative's reimbursement if they are married to the paid DD Waiver provider (such as the other parent) or own or are an officer of the provider organization.Wyoming Department of Health. The Limits on Wyoming DD Waiver Family Caregiver Pay
- Four hours a day of personal care. On Wyoming's DD Waivers, a parent's personal care can't exceed 4 hours a day or 5,840 units a year; PV11 says family members are expected to contribute natural supports. For a parent giving round-the-clock care, pay covers part of the day, not all of it.
- Community living services need more. Wyoming's DD Waivers let a parent provide community living services only if the parent forms an LLC or corporation, is a certified provider or works for one, and doesn't live in the participant's primary residence. A parent can't provide homemaker services on Wyoming's DD Waivers.
- Nothing a family normally does for free. Under Wyoming Medicaid Rules Chapter 45, the DD Waivers pay a relative only for care a relative wouldn't normally give for free and that would otherwise need a qualified provider.
- Approval first. Wyoming's PV11 form, which also applies to spouses, must be approved before relative-provided DD Waiver services are added to the Individualized Plan of Care.Wyoming Department of Health. (2019). How Pay Is Set
As of July 22, 2026, Wyoming's Comprehensive and Supports Waiver Service Index sets the DD Waivers' personal care reimbursement rate at $8.25 per 15-minute unit for an agency provider and $7.36 per 15-minute unit for an independent provider. To qualify for the DD Waivers' agency personal care rate, an agency must employ one or more people other than themselves, hold Division certification for the service, and show legal payment of employee compensation. Those DD Waiver figures are provider reimbursement rates, not a caregiver's wage. If an agency employs you, ask what hourly wage it pays.Wyoming Department of Health. (2019).
