What the Arkansas Medicaid Look-Back Period Counts
Arkansas Medicaid applies its transfer rules only to people applying for or receiving Long Term Services and Supports: nursing facility care and the home and community based (HCBS) waivers. The Medical Services Policy Manual defines the window this way: "The look back period is the 60 months immediately prior to the date on which an individual is both in an institution and has applied for medical assistance or, in the case of a Waiver individual, prior to the date the individual applies for Waiver assistance."U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm
The window is anchored to the application, not to the gift, so it moves. A transfer made 58 months before one filing date can fall outside the window for a later one. If a first application is denied and the person reapplies, the county office asks about transfers in the window measured from the later application. This 60-month rule is the federal Medicaid look-back set by 42 U.S.C. § 1396p for transfers made on or after February 8, 2006; our national guide to the Medicaid look-back period covers the federal rules every state shares.U.S. Social Security Administration. (n.d.). Social Security Act sec. 1917(c) [42 U.S.C. 1396p(c)] - Taking into account certain transfers of assets: look-back date, penalty period, start date, divisor, and the (c)(2) exceptions (SSA Compilation of the Social Security Laws). ssa.gov. Retrieved Oct 8, 2026, from https://www.ssa.gov/OP_Home/ssact/title19/1917.htm
Inside the window, Arkansas starts from a presumption: a transfer for less than fair market value "will be presumed to be for the purpose of establishing eligibility." The same passage says the presumption is "subject to rebuttal" and, in some cases, to exclusion.U.S. Government Publishing Office. The family home gets its own treatment. The Arkansas Penalty Divisor for 2026
Arkansas's Transfer of Assets Divisor is $9,110 a month for April 1, 2026 through March 31, 2027. Arkansas publishes it in MS Appendix R of the Medical Services Appendices, in the edition dated 04/01/2026. The same appendix lists Arkansas's prior divisor, for April 1, 2025 through March 31, 2026, as $8,834.Arkansas Department of Human Services. (2026). Medical Services Policy Manual Appendices (Appendix R, Transfer of Assets Divisor, edition 04/01/2026) — Arkansas Department of Human Services. humanservices.arkansas.gov. Retrieved Oct 15, 2026, from https://humanservices.arkansas.gov/wp-content/uploads/Medical-Services-Appendices-8-26.pdf
Three things about that number matter before you use it:
- It resets every April 1. Arkansas re-determines the divisor each year, so a divisor quoted without its date range can't be checked. Arkansas's next divisor takes effect April 1, 2027.Arkansas Department of Human Services. (2026). Medical Services Policy Manual Appendices (Appendix R, Transfer of Assets Divisor, edition 04/01/2026) — Arkansas Department of Human Services. humanservices.arkansas.gov. Retrieved Oct 15, 2026, from https://humanservices.arkansas.gov/wp-content/uploads/Medical-Services-Appendices-8-26.pdf
- It is built from Medicaid's own rate. MS H-316 defines Arkansas's divisor as "the weighted average per diem Medicaid rate multiplied by 30.42 and rounded to the nearest dollar." The divisor is the number Arkansas divides by, not a quote for what a private nursing home bill will be.Arkansas Department of Human Services. (2026). Medical Services Policy Manual Appendices (Appendix R, Transfer of Assets Divisor, edition 04/01/2026) — Arkansas Department of Human Services. humanservices.arkansas.gov. Retrieved Oct 15, 2026, from https://humanservices.arkansas.gov/wp-content/uploads/Medical-Services-Appendices-8-26.pdf
- A change can reach a penalty already imposed. "When there is a change in the divisor, the penalty period will be reassessed at the next reevaluation, or earlier if requested, or at reapplication."Arkansas Department of Human Services. (2026). Medical Services Policy Manual Appendices (Appendix R, Transfer of Assets Divisor, edition 04/01/2026) — Arkansas Department of Human Services. humanservices.arkansas.gov. Retrieved Oct 15, 2026, from https://humanservices.arkansas.gov/wp-content/uploads/Medical-Services-Appendices-8-26.pdf
That last rule is worth acting on. The same uncompensated value divided by a larger divisor gives a shorter penalty, and the manual lets you ask for the reassessment early rather than waiting for the next reevaluation.
How a Transfer Inside the Arkansas Medicaid Look-Back Period Becomes a Penalty
Arkansas's arithmetic has four rules, all from MS H-308:U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm
- Divide. Months of ineligibility equal the uncompensated value of everything the applicant or spouse transferred on or after the look-back date, divided by the current divisor.
- No cap. "There is no cap on the total number of months of ineligibility."
- Keep the fraction. A leftover fraction "will not be dropped." Arkansas multiplies the leftover fraction by 30 and rounds up to give extra days.
- Add the gifts together. Every transfer in the window counts "regardless of the amount transferred," and the eligibility worker adds them into one total.
The fraction rule matches federal law, which bars a state from rounding down or disregarding a partial period.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. When the Penalty Starts for a Nursing Facility Applicant
For a nursing home applicant or resident, MS H-310 sets the start date: "the penalty period begins on the first day of the month of the transfer or the date on which the individual is eligible for Medicaid, whichever is the later date." Federal law uses the same later-of rule for transfers made on or after February 8, 2006.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm
For a transfer made years before applying, the later date is almost always the eligibility date. So a nursing facility penalty on a transfer still inside the window doesn't run down while the family waits; it starts once the applicant is otherwise eligible.
What the penalty blocks is narrower than a total loss of Medicaid. During an Arkansas nursing facility transfer penalty, the resident "is not eligible for a vendor payment," which is Medicaid's payment to the nursing facility, "but may receive other Medicaid services with the exception of Waiver services." The application "must be approved for Medicaid without the vendor payment if all eligibility requirements have been met." Once a penalty starts, it keeps running even if the resident leaves the facility.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm Our guide to Arkansas Medicaid nursing home coverage covers the rest of that application.
When the Penalty Starts for an ARChoices or Other Waiver Applicant
Arkansas runs a different clock for home and community based waivers such as ARChoices. A waiver applicant who transfers for less than fair market value is ineligible for "all Waiver Medicaid benefits and services" for the penalty period, and that period can only start on the date Medicaid would have been approved if all four of these are true:U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm
- The applicant meets the financial and nonfinancial requirements for Medicaid.
- The applicant meets the waiver's level-of-care criteria.
- A person-centered service plan has been developed.
- A waiver slot is available.
If any one of the four is missing, an Arkansas waiver penalty cannot start. An Arkansas waiver applicant who cannot meet all four is then "not eligible unless the individual enters a nursing facility or until the transfer date moves out of the look back period," and DHS sends Form DHS-707 stating that the penalty "will be total ineligibility for the Waiver program for five years from the date of transfer," unless the person enters a nursing facility or later meets those criteria.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. So for an Arkansas waiver applicant who cannot meet all four criteria, time since the transfer does count: the five-year waiver ineligibility runs from the transfer date, not from an eligibility date. A waiver recipient who transfers after approval has a third rule: the penalty begins on the first day of the month of the transfer.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. Transfers Arkansas Does Not Penalize
MS H-309 lists when "A penalty period shall not be calculated."U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p(c)(2) — exceptions to the transfer-of-assets penalty (U.S. Code, 2024 edition, govinfo). govinfo.gov. | What was transferred, and to whom | The condition Arkansas attaches |
|---|---|
| The home, to a community spouse | Title to the home goes to the community spouse |
| The home, to a child under 21, or a child who is blind or has a disability | Blindness or disability as determined by the Social Security Administration (SSA) or the DHS Medical Review Team (MRT) |
| The home, to a caregiver child | The child lived there at least two years before admission and gave care that kept the parent at home |
| The home, to a sibling | The sibling has an equity interest and lived there at least one year before admission |
| Any resource, to or for the sole benefit of the spouse | A legal document, evidence of sole benefit, and an asset with immediately measurable value to the spouse |
| Any resource, to or in trust for a child who is blind or permanently disabled | Solely for that child's benefit, with the same documentation |
| Any resource, to a trust solely for a person under 65 with a disability | Disability as determined by SSA, MRT or the Railroad Retirement Board |
| A transfer made for another purpose | You show it was at fair market value, for other valuable consideration, or exclusively for a purpose other than qualifying |
| Resources returned, or spent on the applicant's care | All of the resources transferred below value |
| Undue hardship | The four-part test below |
Returning the asset is an exit that can reach any transfer made below value. Under Arkansas's MS H-317, if the transferred resources go back to the person who gave them, "no penalty period will be imposed, i.e., the transfer will be considered as if it had never occurred." The returned money or property may itself keep the person ineligible for a time because of its value, and a partial return only shrinks the penalty to the value not returned.U.S. Government Publishing Office. The DHS-732 Letter and Your 15 Days to Rebut
When the county office finds an uncompensated transfer, Arkansas sends Form DHS-732, saying the transfer "will result in a penalty period unless he/she can provide convincing evidence that the action was exclusively for some purpose other than establishing eligibility." If an Arkansas applicant doesn't answer Form DHS-732 "within 15 days, it will be assumed that he does not wish to rebut."U.S. Government Publishing Office. A rebuttal means presenting convincing evidence that the transfer was for another purpose, with any pertinent documents such as legal documents, realtor agreements and relevant correspondence. MS H-313 lists factors that may show another purpose:U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p(c)(2) — exceptions to the transfer-of-assets penalty (U.S. Code, 2024 edition, govinfo). govinfo.gov. - An unexpected (traumatic) onset of disability after the transfer.
- An unexpected loss of other resources or income after the transfer that would have kept the person from qualifying when the transfer was made.
- The resource, if kept, would not have pushed total resources over the limit at the time.
- A court ordered the transfer to satisfy an obligation that already existed.
One limit is firm: if protecting the asset from medical or nursing home costs "was a factor," the presumption is not rebutted, even when there was another reason too.U.S. Government Publishing Office. Does the Undue Hardship Waiver Fit Your Situation?
A hardship waiver comes only after a transfer has failed both the H-309 exceptions and a rebuttal. MS H-720 says "Undue hardship exists if each condition below is met," and lists four:U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p(c)(2) — exceptions to the transfer-of-assets penalty (U.S. Code, 2024 edition, govinfo). govinfo.gov. Retrieved Oct 15, 2026, from https://www.govinfo.gov/content/pkg/USCODE-2024-title42/html/USCODE-2024-title42-chap7-subchapXIX-sec1396p.htm
- Counting the uncompensated value would make the person ineligible.
- Going without assistance would deprive the person of food, shelter, and medically necessary care.
- The person's total resources can't pay for one month of facility care.
- The resource can't be recovered from whoever received it because of loss, destruction, theft or another extraordinary circumstance.
All four undue hardship conditions must be true at once. A house still held by the relative who received it has not been lost, destroyed or stolen, so it generally does not meet the unrecoverable-resource condition; returning it under MS H-317 is the route to look at first. Hardship "does not exist" when the penalty would merely cause inconvenience or restrict lifestyle without risk of serious deprivation. The person, an authorized representative, or the facility with consent can apply; the Division of County Operations (DCO) Hardship Waiver Committee decides, and an applicant who disagrees can appeal within 35 days of the notice.U.S. Government Publishing Office. Frequently Asked Questions
What is the look-back period for Medicaid in Arkansas?
Sixty months, counted back from the application rather than the gift. For example, a nursing facility resident who applies for Arkansas Medicaid in May 2026 has transfers back to May 2021 reviewed, and a waiver applicant counts back the same 60 months from the waiver application date.U.S. Government Publishing Office. (2024). 42 U.S.C. 1396p — Liens, adjustments and recoveries, and transfers of assets (U.S. Code, 2024 edition, govinfo). govinfo.gov. We gave Mom's house to my brother in 2023. Has any of the penalty already run?
It depends on which care she applies for. For a nursing facility application, an Arkansas penalty starts on the later of the transfer month or the date she is eligible for Medicaid, so none of it has run yet. For an ARChoices or other waiver application that cannot meet the four start criteria, the DHS-707 penalty runs five years from the date of the transfer, so the time since 2023 counts. Check Arkansas's H-309 exceptions first: a home transferred to a child who lived there with the parent for at least two years before admission and gave care that kept the parent at home is exempt from the penalty.U.S. Government Publishing Office. Do small gifts, like birthday checks, count toward an Arkansas penalty?
They can. Arkansas's MS H-308 counts every transfer in the window "regardless of the amount transferred" and adds them into one total. Twelve hypothetical $500 gifts make $6,000, which at the $9,110 divisor is 0.6586 of a month; times 30 and rounded up, that is a 20-day penalty unless the gifts were for another purpose you can show.U.S. Government Publishing Office. Does a transfer penalty mean losing Arkansas Medicaid altogether?
Not for a nursing facility applicant, who is approved without the vendor payment (see the nursing facility section above). For an Arkansas waiver applicant, the penalty falls on waiver benefits and services; see the waiver section.U.S. Government Publishing Office.
