How Memory Care Costs Lower Your Countable Income for Aid and Attendance in Alabama

This is the part most families miss, and it's where memory care and Aid and Attendance fit together in a way that surprises people.

The VA pension is needs-based: to be eligible, your yearly family income and net worth have to meet limits set by Congress.1 Because the benefit is keyed to the income the VA counts, lowering that income is what opens the door, and you lower it by deducting unreimbursed medical expenses.

Memory care fees can count as those medical expenses, on conditions VA sets for a care facility other than a nursing home.1 The facility itself has to qualify: it must be licensed where facilities of its type must be licensed (in Alabama, a memory care community holds a SCALF license), and a residential facility must be staffed with care providers 24 hours a day.1,3 Payments for help with daily activities there count when the resident is receiving health or custodial care in the facility and either needs Aid and Attendance (or is housebound) or a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that, because of a physical, mental, developmental, or cognitive disorder, the person needs to be in a protected environment.1 The meals-and-lodging part of the bill has its own test: it counts if the facility provides or contracts for health or custodial care for the resident, or if one of those clinicians states in writing that the person must live in the facility to receive that care.1 VA's definition of custodial care includes regular supervision of someone whose cognitive disorder means they need care to protect them from the hazards of daily life.1

Recognized wartime periods include World War II, the Korean conflict, the Vietnam War era, and the Gulf War (August 2, 1990, through a date not yet set by law or presidential proclamation).
• Have no dishonorable discharge, and meet at least one of four tests: be at least 65 years old; have a permanent and total disability; be a patient in a nursing home for long-term care because of a disability; or be getting Social Security Disability Insurance or Supplemental Security Income. Any one of the four satisfies this requirement, so a wartime veteran under 65 who receives SSI meets it without any disability rating.
• Need aid and attendance: needing another person's help with daily activities like bathing, feeding, and dressing; having to stay in bed because of illness; being a nursing home patient because of the loss of mental or physical abilities related to a disability; or severely limited eyesight. VA also weighs incapacity that requires regular care to protect the person from everyday hazards, a bar dementia commonly meets.
• Have a net worth under $163,699 for 2026. VA's net worth calculation counts the claimant's and their dependents' assets and their annual income for VA purposes, not assets alone, and it excludes the primary residence, the car, and basic home items.1

Note that you do not need a service-connected disability to qualify.4 The VA also applies a 3-year look-back on assets transferred for less than fair market value before you file, with a penalty period that can run up to five years, so don't give away or move assets to qualify without getting advice first.4

How Aid and Attendance Works with Alabama Medicaid

Aid and Attendance and Medicaid can work together, and for a family paying for memory care that combination matters.

In Alabama, VA Aid and Attendance and Medicaid long-term care are separate programs that interact through income rules. When a veteran applies for Alabama Medicaid long-term care, at the eligibility step, Alabama applies SSI income rules, under which the Aid and Attendance allowance is not counted as income at all, so only the basic pension counts toward the Medicaid income limit. Alabama is an income-cap state ($2,982 a month, 300% of the Supplemental Security Income (SSI) Federal Benefit Rate, in 2026), so applicants over the cap may need a Qualified Income Trust, also called a Miller Trust.5

That exclusion settles eligibility, not the monthly bill. Once your loved one is eligible and living in a nursing facility under Alabama Medicaid, the federal post-eligibility rule, 42 CFR 435.725, says income that was disregarded in determining eligibility must be considered in that process.5 What that means for an Aid and Attendance amount VA is still paying at the full rate depends on the household. Alabama's rule for a married couple, Ala. Admin. Code r. 560-X-25-.16, lists the VA aid and attendance allowance, along with VA payments for unusual and continuing medical expenses, among the mandated deductions for the institutionalized spouse; where there's no spouse at home but other family members are, the same rule leaves the aid and attendance allowance out of the income allocated to them.5 Beyond those two provisions, we haven't confirmed how Alabama counts a full-rate Aid and Attendance amount toward what a resident owes the facility each month, including for a resident with no spouse or family at home, so confirm it with the Alabama Medicaid Agency.5

Medicaid coverage can also shrink the pension itself. For a veteran with no spouse or child, or a surviving spouse with no child, whose nursing-facility care Medicaid covers, federal law caps the VA pension at $90 a month for any period after the month of admission (38 U.S.C. 5503(d)), and for a veteran under that cap, the nursing facility's Medicaid payment can't be reduced by the $90 the veteran keeps.5 A veteran who has a spouse or a child is outside that cap, and so is a stay in a State veterans home for which VA makes the section 1741(a) per diem payment; in such a home, a veteran with no spouse or child who receives more than $90 a month in pension after qualifying for Medicaid has the excess, including any Aid and Attendance, counted only toward the home's cost of care (Social Security Act section 1902(r)(1)(B)). Whether a particular Alabama State Veterans Home falls inside that exclusion is something to check with an accredited Veterans Service Officer.5

Not all of the income that does count reaches the facility, though. Before the state reduces its payment to the nursing home, 42 CFR 435.725(c) requires the agency to deduct five amounts from the resident's total income, in this order: (1) a personal needs allowance for clothing and other personal needs while in the institution; (2) for a resident with only a spouse at home, an amount for that spouse's maintenance needs; (3) for a resident with a family at home, an amount for the family's maintenance needs; (4) incurred expenses for medical or remedial care that no third party will pay, including Medicare and other health-insurance premiums, deductibles and coinsurance; and (5) the full amount of any SSI and state supplementary payments the resident continues to receive. All five are deductions the agency is required to make, not allowances a family has to apply for, and only what remains after them goes to the facility. No single national figure sets those amounts: the state sets the personal needs allowance subject to a federal minimum, and the spouse and family amounts each rest on a reasonable assessment of need, capped by a standard the state's own program uses, so ask the Alabama Medicaid Agency for the figures in your case.5

Because the interaction between VA pension and Alabama Medicaid is complex and fact-specific, confirm your situation with an accredited Alabama county veterans service officer and the Alabama Medicaid Agency before relying on the combination.5 The right order and timing of applications can change the outcome.

How to Apply and Get Accredited Help

The steps below are the pension route, which is the one most memory care families use. VA's condition for it is that you may be eligible for this benefit if you get a VA pension.6 A veteran who already receives VA disability compensation is on a different track: VA describes Form 21-2680 as applying for Aid and Attendance that will be added to your monthly compensation or pension benefits, so the medical form is the same but the pension application below is not.6 If you aren't sure which applies, ask an accredited representative before filing anything.

The forms are:6

• VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance), with the examination section filled out by a medical examiner documenting the need for help, which for dementia means documenting the supervision and hands-on care the person requires.
• VA Form 21P-527EZ (Application for Veterans Pension), for a wartime veteran pursuing the pension route who isn't already receiving a VA pension. On that route the increase takes the form of a higher maximum pension rate that replaces the basic rate, rather than a second payment on top of it.
• VA Form 21-0966 (Intent to File), if you're still gathering information. VA says submitting an intent to file can secure the earliest possible effective date for any retroactive payments you may be eligible to receive, so sending it first protects the date while you collect the rest.

You can file online at VA.gov, by mail to the VA Pension Intake Center, in person at a VA regional office, or with the help of an accredited representative.6 Asked how long a decision takes, VA's own answer is "It depends." ADVA has veterans service offices in 62 counties, split into four districts (Northern, Central, Southern, and Eastern); it says it doesn't have an office in every county, but that it has taken steps to make sure anyone seeking assistance can find help close to home.7 To file for you, a service officer needs you to grant a limited power of attorney on the federal form; without it, the officer can still advise you on your benefits and how to complete the forms, but can't file them or represent you before VA. ADVA may also decline a power of attorney where it decides it can't effectively represent someone, so if your situation is contested or your loved one's competency is in question, ask the office directly.7
