Here's what the 2026 rates look like. The VA publishes them as Maximum Annual Pension Rates (MAPR), effective December 1, 2025 through November 30, 2026. A MAPR is a ceiling, not a payment: VA pays monthly, and under 38 CFR 3.273 it subtracts your countable income from the annual rate and divides the remainder by 12.1

Set the rates against the cost of care. Separately, being a patient in a nursing home due to the loss of mental or physical abilities related to a disability is itself one of the qualifying conditions the VA lists.4

How Memory Care Costs Lower Your Countable Income for Aid and Attendance in New Jersey

This is the part most families miss, and it's where memory care and Aid and Attendance fit together in a way that surprises people.

The VA pension is needs-based: to be eligible, your yearly family income and net worth have to meet limits set by Congress.1 Because eligibility is keyed to income for VA purposes, lowering your countable income is what can bring you within those limits, and you lower it by deducting unreimbursed medical expenses.

Memory care costs can count as those medical expenses, but on conditions VA spells out for a care facility other than a nursing home, the branch of its rules that covers assisted living and similar residential facilities (38 CFR 3.278(d)(3)).1 The facility itself must be licensed if New Jersey requires facilities of its type to be licensed, and a residential facility must be staffed with care providers 24 hours a day.1 Payments for help with daily activities count if the resident is receiving health care or custodial care there and either needs aid and attendance or is housebound, or a physician, physician assistant, certified nurse practitioner, or clinical nurse specialist states in writing that, due to a physical, mental, developmental, or cognitive disorder, the resident needs to be in a protected environment.1 Meals and lodging have their own test: they count if the facility provides or contracts for the resident's health care or custodial care, or if one of those clinicians states in writing that the resident must live in the facility (or a similar one) to receive that care.1

There's one rule to know: only the portion of those expenses above 5% of the applicable annual MAPR is deductible.1 As the VA puts it, you may deduct only the amount above 5% of your MAPR, $872 for a veteran with no spouse or child; the floor is higher if you have dependents, but it never rises with the Aid and Attendance or housebound increase.1 New Jersey care bills run far above that annual floor; the state's assisted-living median alone is $104,520 a year.3 So a veteran whose income looks too high to qualify can still qualify once a year of qualifying memory care charges is deducted, because those costs reduce countable income.1

Who Qualifies

To be eligible for Aid and Attendance, the veteran must:4

• Have wartime service: if you started active duty before September 8, 1980, at least 90 days of active duty with at least one day during a wartime period such as World War II, Korea, the Vietnam War era, or the Gulf War (August 2, 1990 onward). An enlisted member who started after September 7, 1980 generally needs at least 24 months or the full period called to duty, again with at least one wartime day; VA has a separate rule for officers who started after October 16, 1981.
• Have no dishonorable discharge, and meet at least one of these four: be 65 or older; have a permanent and total disability; be a patient in a nursing home for long-term care because of a disability; or be getting Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). Any single one is enough, so a wartime veteran under 65 who receives SSI qualifies on this test without a permanent-and-total rating.
• Need help with daily activities: such as bathing, dressing, or feeding yourself, needing protection from the hazards of the daily environment, or being a patient in a nursing home due to the loss of mental or physical abilities related to a disability.
• Have a net worth under $163,699 for December 1, 2025 through November 30, 2026. VA's net worth calculation counts your and your dependents' assets and annual income for VA purposes, though the primary home and a vehicle are excluded, so comparing savings alone against the limit gives you the wrong answer.4

Note that you do not need a service-connected disability to qualify.4 The VA also applies a 3-year look-back on assets transferred for less than fair market value before you file, with a penalty period that can run up to five years, so don't give away or move assets to qualify without getting advice first.4

How Aid and Attendance Works with New Jersey Medicaid

Aid and Attendance and Medicaid are separate programs run by different agencies under different rules, and a veteran or surviving spouse can often receive both at the same time.5 New Jersey Medicaid (NJ FamilyCare) long-term care is administered by the NJ Department of Human Services, Division of Medical Assistance and Health Services (DMAHS), under its own rules.5

The two programs count income differently, and that matters. For the VA pension, unreimbursed memory care costs can be deducted to lower countable income.5 Medicaid treats VA pension in two separate steps. Deciding eligibility, a state applies SSI income methodologies to aged, blind, and disabled applicants (42 CFR 435.601), and under SSI methodology the Aid and Attendance increase is not counted toward the NJ FamilyCare income limit. New Jersey adds its own rule (Medicaid Communication No. 15-08): a VA pension received because unreimbursed medical expenses reduce your income to $0 is not counted at the eligibility step if you show it with a letter or other documentation from VA, and where those expenses leave income above $0 the application is reviewed case by case. A state that uses criteria more restrictive than SSI may count it differently, so confirm the treatment with DMAHS.5

The second step is the share of cost, or patient liability, for someone already eligible and living in a nursing home or other medical institution. There, federal rules require income disregarded at the eligibility step to be considered (42 CFR 435.725), so an Aid and Attendance amount VA is still paying at the full rate can count toward what the resident owes for care. New Jersey's 2015 instruction also says a Medicaid-eligible person receiving a pension based on medical expenses must notify VA, and that pension stays in the share-of-cost calculation until a VA notice shows it was reduced or eliminated. Beyond that instruction, we can't confirm how New Jersey treats a full-rate Aid and Attendance amount at this step, including for a memory care resident whose care Medicaid covers through MLTSS, so ask your county welfare agency or DMAHS.5,3 Because the rules for layering these benefits get complicated, a Veterans Service Officer or an elder law attorney is worth the call before you commit to a plan.5

How to Apply and Get Free Help

The steps below are the pension route, the one most memory care families use. VA's condition for it is that "You may be eligible for this benefit if you get a VA pension and you meet at least 1 of these requirements," the aid-and-attendance needs covered above.6 There is a second route: VA describes Form 21-2680 as the way to apply for Aid and Attendance "that will be added to your monthly compensation or pension benefits," so a veteran who already receives VA disability compensation rather than a pension files the same medical form toward their compensation, and does not need the wartime pension application below.6

On the pension route, these are the forms:

• VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance), where a medical examiner fills out the examination information section documenting the need for help. For a dementia claim, this is where the examiner describes the cognitive impairment and the daily help it requires.
• VA Form 21P-527EZ (Application for Veterans Pension), if you're a wartime veteran going the pension route and aren't already receiving a VA pension.
• VA Form 21-0966 (Intent to File), if you're still gathering information. Filing it first protects your place in line: as VA puts it, "Submitting an intent to file can secure the earliest possible effective date for any retroactive payments you may be eligible to receive."6
